Welcome to EB.app! These Terms of Service ("Terms") govern your use of our personal budgeting platform. We've written this in plain English to make it easy to understand.

Governing Documents: These Terms incorporate our Privacy Policy and Billing Policy. If any conflict arises between documents, the Privacy Policy governs how we handle personal data, and these Terms govern your use of the Service.

1. About Our Service

EB App LLC ("we," "us," or "our") operates:

• eb.app - Our public website
• my.eb.app - Our budgeting application (web and PWA)
• EB Mobile Apps - Available on Apple App Store and Google Play Store

2. Definitions

• "Service" refers to the EB.app application and all related services provided by EB App LLC.
• "Budget Data" refers to the financial information you enter into the Service, such as income, expenses, transactions, and categories, including any data derived from AI processing.
• "Personal Information" means any information that identifies or can reasonably be linked to an individual, such as your name and email address.
• "Offers" means in-app recommendations of our products or affiliate/partner offerings displayed in the Offers tab. This feature is available ONLY to free-tier users. Premium subscribers do not see Offers. By default, Offers are generated using deterministic, in-app analysis of your Budget Data without AI processing. Free-tier users may optionally click "Try AI Analysis" to send a budget summary (item names, amounts, categories, account balances, and balance projections - NOT detailed transaction history) to Google AI (Gemini API) for personalized offer recommendations. This is entirely optional and user-initiated. Google's processing is governed by the Google Cloud Privacy Notice and Gemini API Terms of Service.
• "Authorized Financial Account Holder" means a natural person who is a legal owner of, or an authorized signer on, a financial account and who has authority to grant EB.app read-only access to that account's data via a bank-link provider (e.g., Plaid).
• "We," "us," or "our" refers to EB App LLC.
• "You" refers to the individual using our Service.

3. Acceptance of Terms

By using EB.app, you agree to these Terms. If you don't agree, please don't use our service.

Eligibility: By using the Service, you represent that you are 18 years of age or older. If we become aware that an account is used by someone under 18, we will close the account and delete its data.

4. Our Service

What We Provide

EB.app is a personal budgeting tool that helps you:

• Track income and expenses
• Create budgets and forecasts
• AI-assisted budget creation (free with "Bring Your Own AI" or integrated for premium)
• View financial data through charts and reports (free tier: future-looking only; premium: historical and future)
• Track transaction history (free tier: limited; premium: unlimited)
• Export your data in JSON or CSV formats
• Offers (Free-Tier Only): A dedicated "Offers" tab that displays in-app affiliate recommendations from third-party financial services providers through our affiliate network partner (CJ Affiliate). This feature includes an optional "Offers AI Analysis" where you can explicitly consent to send a budget summary (NOT transaction history) to Google AI for personalized recommendations.

What We DON'T Provide

Important: We do NOT provide:

• Financial advice or recommendations
• Investment guidance
• Tax advice

Our Service is designed to function as a manual budgeting tool. Future features may offer optional connections to financial institutions to automate data entry. Any such connections will require your explicit consent and will be governed by additional terms.

We are a budgeting tool only. Any financial decisions you make are your sole responsibility.

5. Pricing and Payment

Free Version

Core budgeting features are free forever, including:

• Budgets and accounts
• Budget planner and dashboard
• AI assistance via "Bring Your Own AI"
• Data export capabilities

Premium Subscription

• Price: $9.99 USD per month
• Features: Integrated AI assistant, advanced charts, history tracking
• Billing: Handled by our Merchant of Record, Paddle
• Cancellation & Refunds: For support with your subscription, or to request a cancellation or refund, please contact us at billing@eb.app. You can also manage your subscription directly through the customer portal provided by our payment partner, Paddle, via the link in your receipt.

Payment Processing:

Our Merchant of Record, Paddle, handles all payment processing, tax remittance, invoicing, and refunds. As the legal seller for all transactions, Paddle is responsible for these functions. When you purchase a premium subscription, your transaction and payment data are processed directly by Paddle under their Buyer Terms. By purchasing, you agree to Paddle's Buyer Terms and Privacy Policy.

We receive only limited, non-sensitive data such as your name, subscription status, and transaction ID to manage your account.

Premium features enhance your budgeting experience with seamless AI integration and advanced analytics.

6. Your Account

Creating and Securing Your Account

Your EB.app account is created and accessed exclusively through Google Sign-In. By using our Service, you agree to keep your Google account information accurate and secure. You are responsible for:

• Securing your Google account credentials, including its password and any enabled two-factor authentication methods
• Keeping your login credentials confidential
• All activity that occurs under your EB.app account
• Notifying us immediately at team@eb.app of any unauthorized access to your account

Two-Factor Authentication

For enhanced security, our Service supports Google's 2-Step Verification. We strongly recommend enabling this feature on your Google account to protect your EB.app account from unauthorized access.

Authorized Financial Account Holders

If you choose to use optional bank-linking features (such as connecting to your financial institutions via third-party services like Plaid), you represent and warrant that:

• You are a legal owner of, or an authorized signer on, each financial account you link
• You have the authority to grant EB.app read-only access to that account's data
• You will not link accounts that you do not own or for which you lack legal authority

You are solely responsible for ensuring you have proper authorization before linking any financial account. Unauthorized access to financial accounts may violate applicable laws and the terms of service of your financial institution.

Account Deletion

You can delete your account anytime through:

• Account settings in my.eb.app
• Emailing team@eb.app

When you delete your account:

1. Your account is immediately marked for deletion
2. All data is permanently deleted from active systems within 24 hours
3. Data may persist in encrypted backups for up to 90 days, after which it will be permanently erased
4. You'll receive confirmation when deletion is complete
5. This process cannot be reversed

Account Inactivity

In line with our commitment to data minimization, accounts that have been inactive for a period of 12 consecutive months and do not have an active premium subscription may be scheduled for permanent deletion. We will notify you via email prior to deletion to provide you with an opportunity to keep your account active, as detailed in our Privacy Policy.

7. Privacy and Data

Your Data, Your Control

• You own your budget data
• We only access data when you request support
• Free users: We do not share your budget data with third parties for advertising or profiling. We may use service providers (e.g., Firebase/Google Cloud) to operate the Service as described in our Privacy Policy
• Premium users: Your budget data is processed by AI services (Google AI) for integrated AI features when enabled
• We never sell your personal data for monetary gain

All data collection and processing are governed exclusively by our Privacy Policy.

How We Use Data

We may:

• Count total active users (anonymized)
• Access your account for support (only when you request)
• Send service-related emails (account management, updates)

8. AI Features and Usage

Free Users - "AI Budget Creation" (Bring Your Own AI)

The "AI Budget Creation" feature for free users operates on a "Bring Your Own AI" (BYOAI) model. We provide:

• Structured prompts for external AI services
• JSON import capability for AI-generated budgets
• User-Controlled Privacy (Your data is processed locally and is not sent to our servers. You have full control over what you copy and share with external AI providers.)

You are responsible for complying with the terms of service of any external AI provider you use.

Premium Users - Integrated AI

Premium subscribers gain access to integrated AI features designed to streamline the budgeting process, including:

• Automatic AI budget generation from uploaded bank statements or connected Plaid bank accounts
• Intelligent categorization and organization of your financial data

Fair Use Policy: To ensure service availability for all users, your access to integrated AI features is subject to a fair use policy. Your subscription includes a generous amount of AI processing sufficient for typical personal budgeting needs. Usage allowances reset at the start of each monthly billing period. We reserve the right to manage usage to prevent abuse or activities that are not related to personal budgeting.

AI Control & Consent:

Premium AI features are activated as part of your premium plan setup with your informed consent, and can be disabled at any time in your settings. When AI is disabled, no budget data is sent to Google AI services. AI processing occurs only when you actively use an AI feature (e.g., uploading a bank statement file or submitting transaction data from a linked bank account for AI-assisted reconciliation or budget creation).

Offers AI Analysis (Free-Tier Only)

Our free tier is supported by an "Offers" tab that displays affiliate recommendations. By default, these offers are generated by in-app analysis without AI.

Optional AI Personalization:

• Free-tier users will see an option to "Try AI Analysis" for personalized offers. This is entirely optional and user-initiated.
• Before any data is sent, a pop-up modal will explain that a budget summary (including item names, amounts, categories, and projections, but NOT detailed transaction history) will be sent to Google AI.
• You must explicitly confirm in this modal to proceed. If you do not confirm, no data is sent to Google AI for this purpose.
• This feature is not available to premium subscribers, and transaction data from bank-linked accounts is never used for Offers.

AI Usage Guidelines

When using AI features:

• Use AI only for budget-related tasks
• Don't share sensitive information (SSN, passwords, etc.)
• Verify AI-generated budgets before saving
• Verify transaction matches before accepting them
• Report any AI errors or inappropriate responses

AI Disclaimer: AI responses are generated and may contain errors. The transaction matching feature is AI-powered and may produce incorrect results. Always review and verify AI-created budgets and transaction matches before relying on them.

9. Affiliate Offers and Third-Party Services

About Affiliate Offers

The Offers tab (available to free-tier users only) displays recommendations for financial products and services from third-party providers. These offers are delivered through our affiliate network partner, CJ Affiliate (Commission Junction LLC).

Third-Party Relationships

When you click an affiliate link:

• You leave EB.app and are redirected to a third-party website
• You enter into a direct relationship with that advertiser, not with EB.app
• The advertiser's terms of service and privacy policy apply to your interaction with them
• CJ Affiliate's tracking technology applies during the redirect (see our Privacy Policy for details)

No Endorsement

Display of an offer does not constitute an endorsement or recommendation. We do not:

• Guarantee the quality, safety, or legality of any advertised product or service
• Verify the accuracy of advertiser claims, interest rates, fees, or terms
• Endorse any particular financial product or institution
• Provide advice on whether any offer is suitable for your specific situation

Match Percentages

Offers may display "match percentages" or similar indicators. These are calculated based on general category alignment with your budget data and are provided for informational purposes only. Match percentages are not financial advice and do not indicate that a product is suitable for you. You are responsible for conducting your own research and making your own informed decisions.

Commission Disclosure

We may earn a commission from CJ Affiliate when you complete qualifying actions (such as signing up for a service or making a purchase) after clicking an affiliate link. This compensation helps support the free tier of Essential Budget. Commission arrangements do not affect prices you pay to advertisers.

Your Responsibility

Before acting on any offer, you should:

• Read and understand the advertiser's terms, conditions, and disclosures
• Verify current rates, fees, and terms directly with the advertiser
• Consider whether the product is appropriate for your financial situation
• Consult with qualified financial professionals if needed

10. Acceptable Use

You agree to use EB.app only for personal budgeting. You will NOT:

• Use our service for commercial purposes
• Share, sell, or distribute your account access
• Attempt to hack, disrupt, or harm our service
• Upload malicious content or code
• Violate any laws or regulations
• Impersonate others or provide false information
• Use our service to launder money or facilitate illegal activities

Violation may result in immediate account termination.

11. Intellectual Property

Our Property

We own all rights to:

• The EB.app platform and software
• Our logos, trademarks, and branding
• All code, design, and functionality

Your License

We grant you a limited, non-exclusive, non-transferable license to use our service for personal budgeting only. This license ends if you violate these Terms.

Your Content

You retain ownership of your budget data. By using our service, you grant us permission to store and process your data solely to provide our budgeting service.

Your Responsibilities for Uploaded Data

When you upload, paste, or connect any financial data, you are responsible for:

• Ensuring you have the legal right to provide the data.
• Redacting sensitive information before providing it (if desired).
• Accepting all risks associated with providing financial data.

For Free-Tier "Bring Your Own AI": You are responsible for understanding the terms and privacy policies of any external, third-party AI provider you choose to use. We do not control this process.

For Premium-Tier Integrated AI: By uploading a bank statement or connecting a bank account for AI processing, you acknowledge that you are providing this data to us to be processed by our AI service provider (Google AI) as described in our Privacy Policy. You remain responsible for verifying the accuracy of all AI-generated results.

12. Disclaimers and Limitations

No Warranties

EB.app is provided "AS IS" without warranties of any kind. We don't guarantee:

• Uninterrupted or error-free service
• Accuracy of calculations (please verify important figures)
• Suitability for your specific needs
• Complete security (though we implement industry standards)

No Financial Advice

The Service is designed to function as a manual, user-input budgeting tool. Optional features, such as connecting to your financial institutions via third-party services like Plaid, may be available to automate data entry. Your use of such features is governed by the terms of those third-party services and requires your explicit consent.

Affiliate Offers Disclaimer

With respect to affiliate offers displayed in the Offers tab, we make no warranties or representations regarding:

• The suitability of any product or service for your needs
• The accuracy of interest rates, fees, terms, or other information displayed
• The quality, reliability, or legitimacy of any advertiser or their products
• The availability of any offer at the time you click
• Whether you will qualify for or be approved for any product

Match percentages and recommendations are based on general category alignment and are not financial advice. Always verify terms directly with the advertiser before making any decisions.

Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount you've paid us in the past month
• We're not liable for indirect, incidental, or consequential damages
• We're not responsible for lost profits or data loss
• We're not liable for decisions you make based on using our tool
• We're specifically NOT liable for errors in AI transaction matching
• We're NOT liable for any security breaches resulting from data you choose to upload
• We're NOT liable for any financial losses from incorrect budget calculations

Third-Party and Affiliate Services

We are specifically NOT liable for:

• Any financial losses resulting from products or services you obtain through affiliate links
• Unauthorized charges, fees, or billing disputes with advertisers
• Data breaches or privacy incidents that occur on advertiser or third-party websites
• Service interruptions, errors, or unavailability of advertiser services
• Disputes between you and any advertiser or financial institution
• Actions taken by CJ Affiliate or any advertiser in their capacity as independent controllers

Exceptions: These limitations don't apply to liability we can't legally exclude, such as for gross negligence or willful misconduct.

These limitations apply regardless of the form of action, whether in contract, tort, or otherwise.

Indemnification

You agree to defend and hold us harmless from any claims arising from:

• Your use of our service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Any false or misleading information you provide
• Your interactions with advertisers or third parties you reach through affiliate links, including any transactions, disputes, or claims arising from products or services you obtain

13. Service Availability

We strive for 99.9% uptime but don't guarantee it. We may:

• Perform scheduled maintenance
• Update features or fix bugs
• Modify or discontinue features
• Experience outages beyond our control

We'll try to provide advance notice when possible.

Service Discontinuation

In the event EB.app discontinues the Service, we will provide at least 30 days' notice (unless prohibited by law or technical limitations) to allow you to export your data. After closure, all user data will be deleted in accordance with our Privacy Policy.

14. Geographic Availability and Use

Our Service is hosted and operated in the United States and is intended for residents of the United States. You may access your account while traveling in other locations. Regardless of where you access the Service from, you acknowledge that you are availing yourself of a U.S.-based service, that these Terms are governed by U.S. law, and that you consent to your data being processed in the United States as described in our Privacy Policy.

15. Dispute Resolution

Arbitration Agreement

Exceptions: Small claims court actions and injunctive relief for intellectual property violations. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for matters relating to intellectual property or unauthorized access.

Governing Law

These Terms are governed by Wyoming law, excluding conflict of law principles.

16. Changes to Terms

We may update these Terms occasionally. When we do:

• We'll update the "Effective Date"
• Updated Terms will be posted at eb.app/terms
• If required by applicable law, we will notify you by email or in-app notice before material changes take effect
• Continued use means acceptance of new Terms
